System requirements may apply. Current technical requirements may change as browsers, AI providers, Amazon KDP, and other third-party services change.
1. Software access
Purchase of the software provides access to the software features included with the purchased product or upgrade. Unless a checkout offer expressly states otherwise, the purchase is not a recurring monthly software subscription. No promise of permanent, perpetual, “forever,” or lifetime availability is made.
2. Service availability and changes
The software, features, integrations, supported browsers, supported devices, workflows, and third-party connections may be modified, replaced, suspended, or discontinued when reasonably necessary for security, legal compliance, compatibility, technical maintenance, third-party changes, or commercial operation. Access is provided while the applicable software and service remain commercially available.
3. Third-party services
The software may work with third-party services such as Amazon KDP, OpenAI, web browsers, payment services, or hosting providers. Those services are controlled by third parties. Their pricing, policies, interfaces, availability, limits, and requirements may change without notice. We do not control or guarantee a third party’s continued availability or approval of content.
4. Customer API account and charges
When a feature uses a customer-provided API key, the customer is responsible for that API account, its billing, usage limits, and charges. Generating more text or images may increase the customer’s third-party API bill. The software does not provide an included pool of AI credits unless an offer expressly says so.
5. Amazon KDP publishing
The publishing assistant is designed to reduce manual data entry and file-upload work. It does not guarantee that Amazon will accept, approve, publish, rank, or sell a book. The customer must review all information and files, follow current KDP requirements, confirm required legal and content disclosures, and make the final publishing decision.
6. Reader Bonus and external destinations
If a customer uses the optional Reader Bonus QR Page, the customer controls and is responsible for the destination URL, landing page, forms, downloads, email provider, privacy notices, data collection, and compliance with Amazon KDP and other applicable platform rules. The software does not host that destination, collect reader information, or send reader email. Platform rules can change and the customer must review current requirements before publishing.
7. AI-generated content
The customer is responsible for reviewing generated text and images before use or publication and for complying with current platform rules, intellectual-property laws, and content policies. When a platform requires disclosure of AI-generated content, the customer is responsible for making that disclosure accurately.
8. Intellectual property and prohibited use
Customers may not use the software to knowingly infringe copyrights, trademarks, publicity rights, privacy rights, or other legal rights. Customers are responsible for having the rights needed for any text, images, names, brands, or source material they provide.
9. No earnings guarantee
The software is a creation and publishing tool. No level of sales, royalties, rankings, traffic, profit, or income is promised or guaranteed.
10. Data and credentials
When secure account storage is enabled, a customer-provided AI API key may be encrypted server-side and associated with that customer’s ColorBook Builder account so the API connection can follow the customer’s sign-in between devices. The raw key is not included in book backup archives. The KDP publishing helper does not require the customer to provide their Amazon password to the software. Customers are responsible for protecting their account credentials and devices.
11. Local project storage, limits, and backups
The My Books feature stores book projects locally in the customer’s browser/device. The standard workspace may limit how many projects can remain stored in the app at one time, including separate In Progress and Finished limits. Customers can download editable project archives to their own computer and later restore them when a matching in-app slot is available. Browser/device storage quotas vary and can be reached before the displayed project-count limit. Customers are responsible for maintaining backups of important projects. Clearing browser data, device failure, browser changes, or moving between different local file/origin installations can make locally stored projects unavailable. The software does not guarantee permanent cloud storage unless a separate cloud-storage feature is expressly provided.
12. Refunds
Any refund rights are governed by the refund policy presented with the applicable checkout or sales offer and by any rights required by law.
13. Limitation
To the fullest extent permitted by applicable law, the seller is not responsible for losses caused by a customer’s third-party API charges, third-party platform outages or policy changes, content rejection, account action by a third-party platform, customer publishing choices, or use of generated content without appropriate review.
14. Updates to these terms
These terms may be updated when needed to reflect product, legal, security, or third-party changes. The version presented with the product or purchase governs as required by applicable law.
